SALIENT TERMS AND CONDITIONS FOR HWANGDBS-E'INVEST
1.   The Applicant shall use his/her/its own computer equipment or telecommunication devices (at own cost and expenses) to access a service known as HWANGDBS-E'Invest by establishing a link with an Internet website maintained by HDBS which will enable the Applicant to place orders online for sale and purchase of securities quoted on the Bursa Malaysia Securities Berhad (hereinafter referred to as "Bursa Securities") for the Applicant's account(s), make accounts inquiries, receive quotes and access to research materials and other data and information (hereinafter collectively referred to as "Information") provided through or in relation to the Service (hereinafter referred to as "the Service").
2. The usage of the Service is at the Applicant's sole and absolute risk. The Applicant (whether application is made for basic or full version of the Service) will be required to provide and key-in his/her/its own user ID and two passwords; i.e. Log-on Password and Trading PIN. The Applicant shall be fully responsible for the confidentiality of the user ID and passwords. As for multiple trading accounts, the Applicant (whether application is made for basic or full version of the Service) will hold only one (1) user ID. The particulars reflected in the Order Status shall be deemed accurate at the time the Order Status is displayed. The Applicant shall, immediately upon becoming aware, report any unauthorised, conflicting or inaccurate usage of the Service to the Company. (Call Helpdesk:- 1-800-88-5288 / 604-263 0050).
3. The Applicant acknowledges and agrees that the Company does not make any representations or warranties as to the accuracy or reliability of such information disseminated through the Service which could be provided by third parties. The information does not constitute advice or recommendation in any manner and shall not be construed as offers, invitations or solicitations to trade in the securities concerned. The Applicant acknowledges that the Company and its associates and directors may from time to time own or have a position in the securities concerned.
4. The Applicant acknowledges and agrees that he/she/it is only granted a personal, non-exclusive, non-transferable licence to use the Service and its related software. The Applicant undertakes to protect the intellectual property and legal rights of the Company and shall not reproduce, disseminate, distribute, publish or commercially exploit the Service and the information therein contained without the written consent of the Company. The contents and availability of the Service may be modified at the discretion of the Company.
5. The Service is provided to the Applicant by using the Applicant's Internet access on a personal computer or terminal. Access to the Service is via the Applicant's choice of Internet Service Provider (ISP). The Company shall take all necessary steps to ensure the integrity of its system but shall not be held liable for any loss or damage suffered by the Applicant arising out of any malfunction or disruption, force majeure, hacking by 3rd parties, computer virus or otherwise of the Service which are beyond the control of the Company.
6. The Applicant (whether application is made for basic or full version of the Service) hereby authorised the Company to access the Applicant's CDS Account and to disclose the stock balances to the Applicant for the purpose of viewing and facilitating the sale or purchase of securities transactions through the Service by the Applicant. However, the CDS Account balance status shown may not be current and the applicant is strongly advised to verify such CDS Account balance status with the Company or Dealer's Representative for the accuracy of the stock balances in the Applicant's CDS account before placing any sell orders. The Applicant shall not hold the Company liable for any losses of whatsoever arising from disclosing the stock balances to the Applicant through the access to the Service, including but not limited to the use of or reliance on the stock balance information and execution of sale orders by the Applicants should it exceed the available stock balance provided by the Service.
7. Termination of the Service may be effected by either party giving thirty (30) days written notice without assigning any reason whatsoever. Upon issuance by or receipt of the notice of termination by the Company, the Applicant's trading password will be suspended and the Applicant will NOT be able to send orders or messages to the Applicant's Dealer's Representative. However, the Applicant will have access to the Service for stock information and transaction data for a further thirty (30) days before the Applicant access is terminated. The Company has the discretion to terminate the Service forthwith should there be default by the Applicant or breach of any terms and conditions stipulated by the Company.
8. The Applicant acknowledges and agrees that these terms shall form part of the general terms and conditions of trading and shall be read together with any other Agreements entered into by the Applicant with the Company in respect of the use of the Service.
9. The Applicant acknowledges and agrees to pay the service fees or charges or any other reasonable fees as may be imposed by the Company from time to time for the provision of the Service.
